1. Agreement to these terms

These Terms & Conditions ("Terms") govern your use of prietopaint.com (the "Site"), operated by Prieto Paint Pro LLC ("we," "us," "our"). By accessing or using any part of the Site you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site. We may update these Terms at any time; the effective date above will change when we do, and continued use of the Site means you accept the changes.

2. The Site is informational

The Site describes our painting and related services. Content is provided for general information only and is not professional advice of any kind. We try to keep everything accurate and current, but content may change at any time and we do not guarantee it is complete, current, or error-free.

3. Estimates

Prices discussed by phone, by text, or from photos are good-faith ballpark figures only. They are not offers and do not bind either party. A price becomes binding only when set out in a written estimate or agreement accepted by both you and us. Nothing on the Site constitutes an offer to contract.

4. Photos and materials you send us

When you send us photos or other material about a project, you confirm that you have the right to share them, and you grant us a limited, free-of-charge permission to store, view, and use them solely to evaluate, estimate, schedule, and perform the work. You keep ownership of your photos. We will not use them in marketing or publish them anywhere without asking for your separate permission first. You agree not to send us anything unlawful, harmful, or that infringes anyone else's rights.

5. Text messages

Texting with us is conversational: you message us, and we message you back about your project. We do not send marketing text campaigns. Standard message and data rates from your carrier apply. Text STOP at any time and we will stop messaging you; message frequency depends on your conversation with us.

6. Intellectual property

The Site and everything on it, including text, photographs of our work, the Prieto Paint Pro name, logo and marks, page design, and underlying code, are owned by or licensed to Prieto Paint Pro LLC and are protected by copyright, trademark, and other laws. You may view, download, and print pages for your personal, non-commercial use in considering our services. You may not otherwise copy, republish, sell, or exploit any Site content without our prior written consent. If you believe something on the Site infringes your copyright, see our Copyright & Takedown Policy.

7. Acceptable use

You agree not to use the Site:

We may restrict or block access to the Site at our discretion to protect it or its users.

8. Third-party links and services

The Site may link to third-party websites and relies on third-party services (such as our hosting provider and font delivery). We do not control third parties and are not responsible for their content, policies, or practices. Links are provided for convenience and are not endorsements. Your use of any third-party site is at your own risk and subject to that site's terms.

9. Disclaimer of warranties

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOU USE THE SITE AT YOUR OWN RISK. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PRIETO PAINT PRO LLC AND ITS MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, BUSINESS, GOODWILL, DATA, OR USE, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). Nothing in these Terms limits liability that cannot lawfully be limited, and nothing here alters the terms of any separate written contract for painting services between you and us.

11. Indemnification

You agree to indemnify and hold harmless Prieto Paint Pro LLC and its members, employees, and agents from claims, damages, and reasonable expenses (including attorneys' fees) arising out of your violation of these Terms, your misuse of the Site, or material you send us in violation of Section 4.

12. Governing law and venue

These Terms and your use of the Site are governed by the laws of the State of Florida, without regard to conflict-of-laws principles. Any dispute arising out of the Site will be brought exclusively in the state or federal courts serving Lake County, Florida, and you consent to their jurisdiction. We control the Site from within the United States and make no representation that it is appropriate for use in other locations.

13. General

These Terms and the Privacy Policy are the entire agreement between you and us regarding the Site. If any provision is held unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a transfer of the business.
